The FDA's Food Safety Modernization Act (FSMA) final rule on Foreign Supplier Verification Programs (FSVP) for Importers of Food for Humans and Animals is a welcomed ally in the continued effort to increase supply chain transparency for U.S. based food manufacturers. 

FSVP provides greater oversight into the products coming into the United States, to ensure "importers would be required to perform certain risk-based activities to verify that food imported into the United States has been produced in a manner that provides the same level of public health protection as that required of domestic food producers."

Essentially, the FDA is asking foreign suppliers to establish a financial stake in ensuring the food coming into the United States will be up to the national standards defined by the FDA. The final rule provides foreign suppliers with greater flexibility in meeting specific requirements that better reflect modern supply chains and distribution methods. The FDA has published an overview of key requirements, which includes the following highlights:

  • The Scope – Who is covered, and what are their roles?

  • The Hazard Analysis – What are the known or reasonably foreseeable hazards for imported food?

  • Evaluation of Food Risk and Supplier Performance – What is the evaluation of the risk posed by an imported food and a supplier's performance?

  • Supplier Verification – What supplier verification activities to conduct?

  • Corrective Actions – What needs to be in place if something goes wrong?

  • Exemptions and Modified Standards – Modified requirements for company size, originating location, and food types.

  • Unique Facility Identifiers – Recognizing the Data Universal Numbering System (DUNS) number as an acceptable unique facility identifier (UFI) to accompany each line item of a food product.
